Commonwealth's Attorney  |  Open File Policy

The Albemarle County Commonwealth’s Attorney’s Office believes that it is appropriate for the defendant in a criminal case to understand the evidence against him or her, and as such maintains an open file policy with regard to the prosecution of its criminal cases. Therefore, counsel for the defendant is entitled to contact our office and make an appointment to come to our office to examine the contents of our case file, and with the exception of attorney work product, view the file in its entirety.

This does not entitle counsel to copies of the file, but instead to view the file. Copies of the content to the file are restricted to items set forth in Rule 7C:5 for matters in the General District Court and Juvenile & Domestic Relations Court, and Rule 3A:11 for matters in the Circuit Court.
