The Subdivision Ordinance and Zoning Ordinance allow certain regulations that normally apply to land development projects to be varied, modified, or waived entirely with a variation or exception for Subdivision Ordinance regulations or a Special Exception for Zoning Ordinance regulations. The level of review necessary for either application depends on which regulation is being modified or waived.

  • Special Exceptions may waive, modify, vary, or substitute certain requirements in the Zoning Ordinance if the regulation explicitly allows and requires approval of the Board of Supervisors. Special Exceptions are reviewed concurrently with Site Plans, Special Use Permits, Zoning Map Amendments, and Wireless Service Facilities. While it is similar to a variance, a special exception is less common, as it is only permitted for a use when the applicable section of the ordinance says the section may be “waived or modified by special exception.”
  • Variations and exceptions to the Subdivision Ordinance regulations may be handled by County staff or by the Planning Commission.
